Terms and Conditions
1. YOUR AGREEMENT
By registering for and/or using the Services in any manner, including but not limited to visiting or browsing the Site, you agree to these Terms of Service and all other operating rules, policies and procedures that may be published from time to time on the Site by us, each of which is incorporated by reference and each of which may be updated from time to time without notice to you.
Certain of the Services may be subject to additional terms and conditions specified by us from time to time; your use of such Services is subject to those additional terms and conditions, which are incorporated into these Terms of Service by this reference.
These Terms of Service apply to all users of the Services, including, without limitation, users who are contributors of content, information, and other materials or services, registered or otherwise.
1. FEE STRUCTURE, CHARGES AND PAYMENT.
Registration fee, program/class fee and charges are non-refundable and non-transferable. Payment for program/class fee for each month becomes due and payable before the start of class unless indicated otherwise.
2. HOLIDAYS, CANCELLATION & REPLACEMENT CLASSES
- There is no replacement class for a student who missed class due to his or her personal reasons.
- Replacement class will only be applicable if a class is canceled by a Teacher/Trainer/Tutor or xSpace.
- xSpace is not liable for cancellations due to unexpected situation that is beyond our control. Replacement of such cancellation will depend on availability of trainer and xSpace.
- Replacement of classes is subject to management approval.
- All public holidays are observed. No lessons will be conducted during public holidays.
- If a student is not present for the Program/Class or any part thereof for whatever reason, no replacement classes will be given unless otherwise agreed between the teaching and non-teaching staff (“the stuff”) and the Student and /or a parent/guardian.
3. INFORMATION COLLECTION AND USE.
We collect several different types of information for various purposes to provide and improve our Service to you.
Types of Data Collected
A. Personal Data
While using our Service, we may ask you to provide us with certain personally identifiable information that can be used to contact or identify you ("Personal Data"). Personally identifiable information may include, but is not limited to; Email address, First name and last name, Phone number, Address, State, Province, ZIP/Postal code, City, Cookies and Usage Data.
B. Usage Data
We may also collect information how the Service is accessed and used ("Usage Data"). This Usage Data may include information such as your computer's Internet Protocol address (e.g. IP address), browser type, browser version, the pages of our Service that you visit, the time and date of your visit, the time spent on those pages, unique device identifiers and other diagnostic data.
C. Tracking Cookies Data
Cookies are files with a small amount of data which may include an anonymous unique identifier. Cookies are sent to your browser from a website and stored on your device. You can instruct your browser to refuse all cookies or to indicate when a cookie is being sent. However, if you do not accept cookies, you may not be able to use some portions of our Service.
Examples of Cookies we use:
• Session Cookies. We use Session Cookies to operate our Service.
• Preference Cookies. We use Preference Cookies to remember your preferences and various settings.
• Security Cookies. We use Security Cookies for security purposes.
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. What constitutes a material change will be determined at our sole discretion.
By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.
When you create an account with us, you must provide us information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the terms, which may result in immediate termination of your account on our Service.
6. GOVERNING LAW.
These Terms shall be governed and construed in accordance with the laws of Malaysia, without regard to its conflict of law provisions.
Our failure to enforce any rights or provison of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have between us regarding the Service.
7. CAMP TERMS & CONDITION
Each program/camp has a maximum number of seats and various per program/camp. Students beyond the maximum number will be placed on a wait list. The wait list is based on first come first served. For more info about maximum seat per program/camp, please contact our xSpace Team at firstname.lastname@example.org. Only students who have submitted a completed registration document will be placed on the wait list.
Registration is only completed once the program/camp deposit or full fees are received by Mind Space. Applicants may place a non-refundable deposit for per student at the equivalent of RM 100 per program/camp per student at any time. This deposit will provide a reserved seat in the camp until the stated deadline for each program/camp. Should a student's full fees not be received by the stipulated date, the reserved seats will be released.
Early bird fees are only applicable if the program/camp carries one and if fees (not applicable to deposits) are received in full before the expiry of the early bird price promotion for each of the program/camp, if any. Registrations received before the early bird price expiry WITHOUT receipt of camp fees will NOT enjoy the early bird price should camp fees be received after the expiry of the promotion period.
An applicant's deposit will remain credited to them for other Mind Space programs if it is forfeited for any of our program/camps.
8. MEDICAL CONSENT
Consent to give permission for the Student to participate in the Program/Camp and all related activities (“the Program”) from the commencement date of the Program/Camp up to its completion as informed by the teaching and/or non-teaching staff (“the Staff”) of the Program/Camp. This includes but is not limited to transportation to, from and during activities.
To understand that some activities may include risk of personal injuries and that adequate supervision of all activities will be maintained. To release the Staff, directors, employees and agents from any liability, injury or illness that the Student may sustain during the Program/Camp.
To grant permission and authorization to the Staff to take the Student to a doctor or a hospital if such need arises. To authorize emergency medical treatment and assume responsibility of all medical bills. Further, should it be necessary for the Student to return home due to medical issues, disciplinary or other reasons, to will assume all transportation costs. All decisions pertaining to the Student’s return will be left to the discretion of the Staff.
It is intended that the medical information submitted for each student applicant in this registration be presented to the physician or appropriate hospital or medical representative at such time as the medical care shall be authorized. It is intended that the authorization shall relieve the physician or any other person rendering such care at the hospital or any such institution in which care and treatment are given, from any liability resulting in my/our inability, the undersigned, to execute a consent or authorization to render such care. It is my/our intent that the Staff shall act in my stead in making such decisions
To agree to notify the Staff in writing of any changes at the earliest convenience.
To agree that the Student will take responsibility for his own medication and dosages and that the Staff are not responsible for monitoring or administering medications, if any.
9. MEDIA CONSENT
The Program and Mind Space Sdn Bhd and its subsidiaries, associated and/or affiliated companies and its initiatives (“Mind Space”) highlight the activities of the Program and its students in a variety of ways including but not limited to its website, e-newsletter, all related social media outlets, brochures, outreach materials and publications. In promoting the Program, Mind Space may use the Student’s first name, images and/or work including but not limited to photographs, video and/or audio recordings, quotations, writing and artwork.
In addition, photographs, videos and/or audio recordings of student performances and samples of student work intended for publication or display may be stored in the archives at Mind Space for preservation and research purposes. To agree that the Student will take responsibility for his own medication and dosages and that the Staff are not responsible for monitoring or administering medications, if any.
